Welcome to Portrait Palette. This website and online store are operated by SAILINGART LLC, doing business as Portrait Palette. Throughout these Terms of Service, the terms "we," "us," and "our" refer to SAILINGART LLC / Portrait Palette.

These Terms of Service ("Terms") govern your access to and use of portraitpalette.com, including any purchases, custom portrait commissions, communications, content, features, and services made available through the website (collectively, the "Services").

By accessing our website, placing an order, or using any part of the Services, you agree to these Terms as well as our Privacy Policy, Refund & Revisions Policy, Shipping Policy, and other policies made available through the website. If you do not agree to these Terms, please do not use the Services.

1. Our Custom Portrait Service

Portrait Palette creates custom, hand-painted oil portraits based on photographs, instructions, and other reference materials provided by customers.

Each commissioned painting is individually created by hand. Because the artwork is handmade rather than mechanically reproduced, the finished painting may contain natural artistic variations in brushwork, color, texture, lighting, proportions, and other details.

Digital screens and photographs may also display colors differently from the physical artwork. Minor differences between a digital mockup, a photograph of the completed painting, and the physical painting are normal and are not, by themselves, considered defects.

2. Photographs and Reference Materials

You are responsible for ensuring that you have the right or permission to submit any photographs, images, text, logos, or other reference materials that you provide to us for use in your commission.

By submitting reference materials, you represent that our use of those materials for the purpose of completing your order will not knowingly violate the rights of another person or entity.

You grant Portrait Palette a limited, non-exclusive license to use the materials you provide solely as reasonably necessary to communicate with you, prepare your mockup, create your commissioned artwork, provide revisions, fulfill your order, and provide related customer service.

Submission of photographs for a commission does not transfer ownership of those photographs to Portrait Palette.

We will not treat customer-provided photographs as our own original photographic works. Any broader use of customer materials for advertising, portfolio, promotional, or social media purposes will be subject to applicable law and, where appropriate, separate permission or consent.

3. Mockup and Approval Process

Before painting begins, we generally prepare a digital mockup or concept image based on the photographs and instructions provided with your order.

The mockup is intended to establish the planned composition, subject placement, background, pose, cropping, and other major visual elements. It is not intended to represent the exact brushwork, texture, or final appearance of the physical oil painting.

You are responsible for reviewing the mockup carefully and communicating any requested changes before approving it.

Once you approve the mockup, you authorize us to begin the physical painting based substantially on the approved concept and the reference materials provided.

Requests made after painting has begun that substantially change the previously approved composition, subjects, source photographs, poses, background, or other major elements may require additional production time and may be treated as a change in the original scope of the commission. Any material change in price, if applicable, will be discussed with you before proceeding.

4. Revisions and Final Approval

After the painting is completed, we will provide a photograph of the finished artwork for your review before shipment.

You may request reasonable revisions to the completed portrait before it ships. We will work with you in good faith to address reasonable concerns regarding likeness, details, and other aspects of the finished artwork.

Certain changes may be limited by the physical nature of oil painting or by the stage of completion. A completed oil painting cannot always be altered in the same way as a digital image.

Once you approve the finished painting for shipment, that approval confirms that you have reviewed and accepted
